Terms of Service

Nutrii is a food and nutrition information app designed to help users better understand foods, ingredients, nutrition labels, and related product information. Nutrii may allow users to scan barcodes, search foods, upload or enter product information, view nutrition summaries, receive food insights, and access AI-generated explanations.

Nutrii is intended for general informational and educational purposes only. Nutrii is not a medical device, healthcare provider, dietitian, nutritionist, allergy specialist, or emergency service.

Nutrii does not provide medical advice, diagnosis, treatment, dietary prescriptions, allergy advice, or professional healthcare guidance.

Any information provided through Nutrii, including food scores, ingredient explanations, health-related comments, AI-generated summaries, nutrition estimates, product comparisons, or product ratings, is provided for general informational purposes only.

You should not rely on Nutrii as a substitute for advice from a physician, registered dietitian, nutritionist, allergist, or other qualified professional. Always consult a qualified professional before making decisions related to your health, diet, allergies, medical conditions, medications, pregnancy, eating disorders, weight loss, diabetes, heart conditions, or any other health-related matter.

If you believe you may be experiencing a medical emergency or allergic reaction, call emergency services immediately.

Nutrii may use third-party databases, public data, user-submitted information, product labels, barcode data, AI systems, optical character recognition, or other sources to provide food and nutrition information.

Zaphon AI, LLC does not guarantee that any food, ingredient, nutrition fact, calorie count, macro count, allergen warning, health score, product rating, recommendation, or explanation is accurate, complete, current, or suitable for your needs.

Food manufacturers may change ingredients, serving sizes, allergens, labels, formulas, packaging, or nutrition facts at any time. Barcode data may be outdated, incomplete, mismatched, or incorrect. AI-generated outputs may contain errors, incomplete information, or misleading interpretations.

You are responsible for checking the product packaging, nutrition label, ingredient list, allergen statement, manufacturer website, and other official sources before consuming or purchasing any food.

Nutrii should not be used as your only source for allergy, intolerance, or ingredient safety information.

If you have allergies, intolerances, sensitivities, dietary restrictions, religious dietary rules, medical dietary requirements, or other food-related safety concerns, you must independently verify all product information before consuming any food.

Nutrii may fail to detect allergens, cross-contamination risks, hidden ingredients, ingredient derivatives, label changes, or manufacturing changes.

You agree that you are solely responsible for your food choices, purchases, and consumption decisions.

Nutrii does not guarantee that use of the app will improve your health, cause weight loss, prevent disease, improve fitness, improve energy, improve body composition, or produce any specific outcome.

Any scores, ratings, labels, recommendations, summaries, or explanations are informational only and should not be treated as guarantees, professional advice, or personalized health instructions.

You must be at least 13 years old to use Nutrii.

If you are under the age of majority in your jurisdiction, you may only use Nutrii with permission from a parent or legal guardian.

By using Nutrii, you represent that you are legally able to agree to these Terms.

Nutrii may allow access with or without an account. If Nutrii offers accounts, login features, or user profiles, you are responsible for maintaining the confidentiality of your login information and for all activity under your account.

Zaphon AI, LLC reserves the right to suspend, restrict, or terminate your access to Nutrii if we believe you have violated these Terms, misused the app, created risk for others, or used the app unlawfully.

Nutrii may offer paid subscriptions, premium features, credits, trials, or other in-app purchases.

If you purchase a subscription or in-app purchase through Apple's App Store, payment will be charged to your Apple Account. Subscriptions automatically renew unless canceled before the end of the current billing period, according to Apple's rules and the subscription terms shown at purchase.

You can manage or cancel your subscription through your Apple Account settings. Deleting the app does not automatically cancel your subscription.

Subscription pricing, duration, trial availability, and included features may vary by region, user, promotional offer, or time. Zaphon AI, LLC may change pricing or features where permitted by law and Apple's policies.

Refunds for purchases made through Apple are handled by Apple, unless otherwise required by applicable law. Zaphon AI, LLC does not control Apple's refund decisions.

Nutrii may offer free trials, discounted subscriptions, promotional credits, or limited-time offers.

Unless stated otherwise at the time of purchase, when a free trial ends, your subscription may automatically convert into a paid subscription unless canceled before the trial period ends.

Zaphon AI, LLC reserves the right to modify, limit, revoke, or discontinue promotions at any time, subject to applicable law and Apple's rules.

Nutrii may allow you to submit, upload, scan, photograph, enter, or otherwise provide content, including food labels, product photos, ingredient lists, nutrition labels, barcodes, text, preferences, feedback, or other information.

You retain ownership of content you provide. However, you grant Zaphon AI, LLC a non-exclusive, worldwide, royalty-free license to use, process, store, display, reproduce, modify, and analyze your content as necessary to operate, improve, secure, and provide Nutrii.

You represent that you have the right to provide any content you submit and that your content does not violate the law, infringe anyone's rights, or contain harmful, misleading, illegal, or abusive material.

Do not upload private, sensitive, illegal, or personally identifying information unless necessary for your use of the app.

Nutrii may use artificial intelligence or automated systems to generate explanations, food insights, ingredient summaries, comparisons, product ratings, or other outputs.

AI-generated content may be inaccurate, incomplete, outdated, biased, or inappropriate for your specific situation. You should independently verify important information before relying on it.

You agree not to treat AI-generated content as medical advice, professional nutrition advice, allergy advice, legal advice, or any other professional advice.

You agree not to:

• Use Nutrii for unlawful, harmful, fraudulent, abusive, or deceptive purposes.
• Rely on Nutrii to make medical, emergency, allergy, or safety-critical decisions.
• Reverse engineer, copy, scrape, modify, or interfere with Nutrii.
• Use Nutrii to build a competing product, service, database, or dataset.
• Upload malicious code, spam, or harmful content.
• Misrepresent your identity or ownership of submitted content.
• Abuse subscriptions, trials, refunds, credits, or promotions.
• Interfere with the app's security, servers, systems, or third-party services.
• Use Nutrii in a way that violates Apple's rules, applicable laws, or the rights of others.

Zaphon AI, LLC may limit, suspend, or terminate access for violations.

Nutrii, including its software, design, branding, logos, text, graphics, scoring systems, features, interface, and related content, is owned by Zaphon AI, LLC or its licensors.

These Terms do not transfer ownership of Nutrii to you. Zaphon AI, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Nutrii for personal, non-commercial purposes in accordance with these Terms.

You may not copy, sell, rent, sublicense, distribute, modify, or create derivative works from Nutrii except as expressly permitted by Zaphon AI, LLC.

Nutrii may rely on third-party services, databases, APIs, AI providers, analytics tools, payment processors, cloud hosting providers, barcode databases, or other vendors.

Zaphon AI, LLC is not responsible for third-party services, data, websites, content, or policies. Your use of third-party services may be subject to their own terms and privacy policies.

Nutrii may display or reference third-party food products, brands, trademarks, nutrition labels, or ingredients. Such references are for informational purposes only and do not imply endorsement, sponsorship, or affiliation.

Your use of Nutrii is also governed by the Nutrii Privacy Policy, which explains how Zaphon AI, LLC collects, uses, stores, and shares information.

The Privacy Policy is available in the app, on Nutrii's App Store listing, or wherever these Terms are made available.

By using Nutrii, you agree to the Nutrii Privacy Policy.

If you downloaded Nutrii from Apple's App Store, your use of Nutrii is also subject to Apple's applicable terms, including Apple's standard app license terms and Apple Media Services terms.

Apple is not responsible for providing maintenance or support for Nutrii. To the maximum extent permitted by law, Apple has no warranty obligation with respect to Nutrii.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

Zaphon AI, LLC may modify, update, improve, remove, suspend, or discontinue any part of Nutrii at any time.

Zaphon AI, LLC does not guarantee that Nutrii will always be available, uninterrupted, secure, or error-free.

Some features may require an internet connection, compatible device, supported operating system, active subscription, or access to third-party services.

Nutrii is provided "as is" and "as available."

To the maximum extent permitted by law, Zaphon AI, LLC disclaims all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, merchantability, non-infringement, availability, security, and error-free operation.

Zaphon AI, LLC does not warrant that Nutrii will meet your needs, that results will be accurate, that nutrition information will be complete, that allergen information will be correct, or that the app will be free of bugs, interruptions, or harmful components.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

To the maximum extent permitted by law, Zaphon AI, LLC, its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or enhanced damages, including lost profits, lost data, personal injury, health consequences, food-related harm, allergy-related harm, or damages arising from reliance on Nutrii.

To the maximum extent permitted by law, the total liability of Zaphon AI, LLC for any claim relating to Nutrii or these Terms will not exceed the greater of: the amount you paid to Zaphon AI, LLC for Nutrii during the three months before the claim arose; or $100.

This limitation applies regardless of the legal theory, including contract, tort, negligence, strict liability, warranty, or otherwise.

Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to defend, indemnify, and hold harmless Zaphon AI, LLC, its owners, officers, employees, contractors, affiliates, service providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• your use or misuse of Nutrii;
• your violation of these Terms;
• your violation of any law or third-party right;
• content you submit to Nutrii;
• your food, health, allergy, diet, purchase, or consumption decisions.

You may stop using Nutrii at any time.

Zaphon AI, LLC may suspend or terminate your access to Nutrii at any time if we believe you violated these Terms, created risk, misused the app, or if we discontinue the app.

Termination does not automatically cancel subscriptions purchased through Apple. You must cancel subscriptions through your Apple Account settings.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and Apple-related terms.

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, except where your local consumer protection laws require otherwise.

Before filing a claim, you agree to contact Zaphon AI, LLC at jmartone2008@gmail.com and attempt to resolve the dispute informally.

To the maximum extent permitted by law, any dispute arising from or relating to these Terms or Nutrii will be resolved through binding arbitration on an individual basis, rather than in court.

The arbitration will take place in Albany County, New York, unless Zaphon AI, LLC and you agree otherwise or applicable law requires a different location.

You and Zaphon AI, LLC waive the right to a jury trial and the right to participate in a class action, class arbitration, consolidated action, or representative action, to the maximum extent permitted by law.

This section does not prevent either party from seeking relief in small claims court where permitted, or from seeking injunctive relief for intellectual property misuse, unauthorized access, or misuse of Nutrii.

Zaphon AI, LLC may update these Terms from time to time.

If we make material changes, we may notify you through the app, by email, through the App Store listing, or by other reasonable means.

Your continued use of Nutrii after updated Terms become effective means you accept the updated Terms.

If you do not agree to the updated Terms, stop using Nutrii and cancel any active subscription.
